The following Booking Conditions together with the Important Information, our Privacy Policy and any other written information we brought to your attention before we confirmed your booking form the basis of your contract with Coach Journeys New Zealand.
Please read them carefully as they outline our respective rights and obligations. By using our services and by booking a tour, you accept and agree that you have read, understood, and agree to be bound by our booking conditions without limitation or qualification.
It is important to note that Coach Journeys New Zealand has an agency agreement with our coach tour operators. This means that we are acting as an agent and representing all coach operators on their behalf. Upon confirming your booking you will enter into a direct contractual relationship with third-party suppliers and your booking will also be subject to those third-party supplier terms and conditions.
1. Individual Authorisation
When an individual accepts these booking conditions, they do so on behalf of all individuals included in their booking. On behalf of themselves and all other persons named on the booking, they accept these conditions and represent that all individuals have authorised to accept them.
Within our booking conditions, “you” and “your” means all persons named on the booking (including anyone who is added or substituted at a later date) or any of them, as the context requires. “Coach Journeys New Zealand”, “We”, “us” and “our” means Coach Journeys New Zealand Limited and its directors, agents and employees.
2. Your Travel Contract
When booking a tour through Coach Journeys New Zealand, you guarantee that you accept (and have the authority to accept on behalf of your party), the terms of the following booking conditions. A contract will become active as soon as your holiday confirmation is issued by us. It is your own responsibility to provide complete and accurate details at the time of booking. It is your own responsibility to check over the tour confirmation issued to you and make sure that it is accurate. Should details not be correct you must inform Coach Journeys New Zealand immediately. Any additional charges incurred as a result of incorrect details being provided will be passed on.
3. Your Responsibilities
3.1 Your passport, visa and other immigration requirements are your complete responsibility. We do not accept any responsibility if you are prevented from travel because you have failed to comply with any passport, visa or immigration requirements.
3.2 The responsibility for your own behaviour or that of members of your party falls to you. We reserve the right to refuse or cancel your booking or remove you or any members of your party if you exhibit any disruptive, intimidating, antisocial or disruptive behaviour. No refund or compensation will be payable in the event of this happening. You will be responsible for any curtailment expenses that occurred.
3.3 You must acknowledge and comply with the terms and conditions of the third-party suppliers that form either all or part of your holiday package. By completing your booking you will enter into a direct contractual relationship with third-party suppliers. We are not a party to the contractual relationship between you and the third-party supplier and are merely acting as an agent. We can provide you with copies of the relevant third-party supplier terms and conditions upon request.
3.4 Your vaccination status must be in line with the guidelines set out by the New Zealand government from time to time.
4. Prices, Currencies & Inclusions
Prices on this website are based on New Zealand Dollars (NZ$) and include 15% GST (Goods and Services Tax) where relevant. All holidays are charged in New Zealand Dollars.
All of our prices are subject to availability and we can withdraw or vary our pricing at any time (including quotes which are subject to change). The price is only guaranteed once you have made your booking and paid the deposit.
We can provide you with detailed travel arrangements in our travel quote. Items not specifically included in your quote are not included in the services we have quoted.
5. Payment
In order to confirm your chosen New Zealand coach holiday, a non refundable deposit of 20% per person (or full payment if booking within 90 days of departure) must be paid at the time of reservation or booking. Deposits are non-transferable and non-refundable, we therefore recommend that you have adequate insurance to cover this.
When making a secure payment online you may be charged a merchant fee, this is subject to change in accordance with our current rates. There is also an option to pay via direct bank transfer.
By making a payment for your travel arrangements, you acknowledge these booking conditions and agree to be bound by them. Your booking will be accepted once we send you a written confirmation, and a contract is formed at this time.
We must receive the balance of the tour price (after deducting the deposit) at least 90 days before your tour begins. Booking less than 90 days before your departure date will require payment in full at the time of booking.
In the event that you fail to make your final payment when it is due, we reserve the right to cancel your booking and keep the deposit you have made. When your final payment is due, we will notify you in writing, and we will not cancel your tour arrangements without first notifying you.
Client monies are held in a separate trust account from the company's operational accounts by Coach Journeys New Zealand. Customer funds are stored here in trust until payments are due to our suppliers or travel begins. Our client trust account holds all funds received from clients, less a non-refundable portion of 3% of your total tour cost.
You indemnify us for all losses, costs, expenses, and claims we incur if a bank determines that a payment made by you is fraudulent.
6. Cancellation Policy
6.1 Cancellations by you
The party leader may cancel your holiday at any time as long as it is in writing and received by us, including by email. As soon as we receive your cancellation, it will become effective. A cancellation charge is expressed as a percentage of the total tour price and is based on the number of days' notice provided before the start of the tour. You will be liable for any increases in holiday or vacation prices if one or more members of a party cancel.
As we incur costs from the date we confirm your booking we will retain your deposit and in addition apply cancellation charges up to the maximum amount depicted below. Our recommendation is to purchase appropriate travel insurance.
Cancellation 60 - 31 days before your coach tour departure date
If you cancel your coach tour 60-31 days before the start of your departure date the cancellation fee will be 50% of the total booking reservation amount, plus any third-party cancellation fees subject to their terms.
Cancellation 30 days or less before your coach tour departure date
If you cancel your coach tour 30 days or less before the start of your departure date the cancellation fee will be 100% of the total booking reservation amount.
NOTE: Depending on the reason for cancellation (if covered by your insurance company), you may be able to reclaim an amount of these charges.
6.2 Conditions of Suppliers & Operators
There may be various suppliers and operators who provide the services that make up your coach tour holiday. These suppliers and operators provide services in accordance with their own terms and conditions, which form part of our contract with you. Our terms and conditions may limit or exclude the supplier's liability to you. The relevant parts of these terms and conditions are available upon request from us. 6.3 Cancellation by You due to Unavoidable & Extraordinary Circumstances
When "unavoidable and extraordinary circumstances" occur at your holiday destination or its immediate vicinity and significantly affect the performance of your holiday or the transport arrangements to the destination, you can cancel your confirmed holiday before departure without paying a cancellation charge. If such a situation arises, we will refund you the monies you have paid that are recoverable but you expressly acknowledge that some monies may not be recoverable by you.
As defined by this clause, "unavoidable and extraordinary circumstances" include warfare, acts of terrorism, significant risks to human health, such as an outbreak of a serious disease at the travel destination or natural disasters, such as floods, earthquakes or weather conditions, that prevent a traveller from traveling in a safe manner.
6.4 Cancellations by us or our third-party suppliers
We will work with you to make similar alternative arrangements if we or one of our suppliers are unable to provide any part of the services you have requested. Should we not be able to provide you with an alternative you are satisfied with, we will refund the cost of those services to you.
In the event of a cancellation, we will not be responsible for any incidental costs and expenses, including but not limited to insurance excesses or non-refundable flights.
7. Third-party Suppliers
When you make a booking with us, we may be acting as an agent for various third-party suppliers and operators who provide the services that make up your holiday. You expressly authorise us to provide booking services on your behalf to make travel booking arrangements and arrange a contract between you and third-party suppliers and operators. These third-party suppliers and operators will provide their services to you in accordance with their own terms and conditions. By making a booking through us you are entering into a direct contractual relationship with those third-party suppliers and you agree to the terms and conditions of the relevant third-party supplier.
Our terms and conditions may further limit or exclude the supplier's liability to you. The relevant parts of the third-party supplier terms and conditions are available upon request from us. It is important that you read the third-party supplier’s own terms and conditions before completing your booking. Please contact us for any further information.
We take care in the selecting of third-party suppliers and operators however we do not have any control over the goods and services provided by those organisations.
Your rights in relation to arrangements with those third-party suppliers and operators will be against the relevant provider and, except if a problem is caused by us, then you will only have rights against that third-party supplier and not us. You agree that we shall have no liability in connection with the provision of services by any third-party supplier or operator.
8. Travel Insurance
Our strong recommendation is that you seek local and professional advice regarding your specific insurance needs when you make your reservation. Please be aware that your tour price does not include travel insurance. It is your responsibility and highly recommended by us, to ensure that your insurance fully covers all your personal requirements. Please read your policy details carefully and bring them with you on your New Zealand coach tour.
9. Itinerary Alterations
If you need to make any changes to your coach touring vacation after we have confirmed your trip, and during travel, we will do our best to facilitate your needs. Please note that we cannot always guarantee this. Any changes requested by you must be in writing.
10. Medical Statement & Special Requests
As a condition of booking, you confirm that you are in good health and have informed us fully of any medical conditions that may affect travel.
During the booking process, please inform us of any special requests you may have i.e. dietary, religious or accessibility requests. We will do our best to pass on any reasonable request you may have to the relevant supplier, but we cannot guarantee it will be met. If we are unable to meet a special request, we will not be in breach of contract. The inclusion of a special request on your confirmation invoice or any other documentation does not confirm that the request will be met.
Whenever a change in the condition or disability occurs, you must let us know in writing. In addition, if any medical condition or disability affects your holiday after your booking has been confirmed, you must promptly inform us. We must reserve the right to decline a reservation if we feel unable to accommodate the specific needs of the guest.
11. Website Advertising & Material Accuracy
Our website and other advertising material contain information that we believe to be accurate at the time of publication. Images that have been used on our website portray destinations as a guide, and may not fully represent the actual touring locations. It is possible that errors may sometimes occur and that information may change in the future. Therefore, please ensure you check all details (such as the price) with us before booking your coach tour.
Any website and other advertising material that relates to a third-party supplier is based on information that has been supplied by that third-party supplier and the third-party supplier is solely responsible for the accuracy of such information, including all updates.
Our website content is protected by law, including laws governing copyright and other intellectual property rights. You may not use, transfer, or copy, any of the website content for public or commercial use without our permission. You may only print, download extracts, or use any pages of the website for personal use.
12. Declaration & Discharge of Liability
Your acceptance of the above terms and conditions indicates that you have carefully read them, understand all of them, and acknowledge the inherent dangers of travel.
You acknowledge that all travellers are subject to the terms and conditions of the third-party operator conducting their travel arrangements.
Due to the extensive number of the third-party suppliers and operators we work with from time to time, it is not feasible to list all third-party supplier terms and conditions here. However, upon request, we are able to provide the specific terms and conditions of individual providers or address any particular inquiries you may have. At the time of reservation, we will provide you with key information that we deem important for you to know. However, it is ultimately your sole responsibility to review and ensure that you are satisfied with third party supplier terms (noting that our terms and conditions may limit or exclude a supplier’s liability to you).
You declare and agree that to the fullest extent permissible under law you release and discharge Coach Journeys New Zealand and its owners, employees, subcontracted activity, service providers, and business partners from liability for bodily injury, death, property damage or theft, and any of the consequences thereof, arising from participation in the tour.
As a member of the traveling party, you agree to this release of liability on behalf of yourself and the other members of your party.
From time to time you might request our assistance to refer you to other organisations who provide goods or services in the travel industry including but not limited to insurance, flights and currency exchange services. When we refer you to those other organisations in terms of the selection we make no representations and give no warranties in relation to such arrangements and you must proceed entirely of your own volition. You must make your own enquiries in all respects as to the suitability of those arrangements and other organisations. You acknowledge and agree that you are not relying on any representations made by us or our team when choosing to proceed with such goods or services.
To the fullest extent permissible under law, neither we nor any of our related companies, directors, officers, employees, or agents accept any liability in contract, tort or otherwise for any loss (including special and consequential loss), liability, injury, damage, delay, additional expenses or inconvenience caused directly or indirectly by acts, omissions or default (whether negligent or otherwise) of third-party suppliers or operators or in the case of force majeure or any other event which is beyond our reasonable control. In any case where our liability is not able to be excluded then any such liability is limited to the fullest extent available under law. Where the New Zealand Consumer Guarantees Act 1993 applies then nothing in these booking terms will limit your rights under that Act.
13. Privacy and Security
Please read our Privacy Policy so that you can understand how we collect, use, and store, information about you.
You agree that we may collect, store, and use your personal information to enable you to use our services and to make bookings with third-party suppliers. You agree for us to share your personal information to third parties for the purposes of enabling your booking to be processed and completed. Where we disclose your personal information to third-party suppliers then those third-party suppliers are responsible for how they handle your personal information. We take reasonable steps to ensure the third-party recipients comply with New Zealand privacy laws.
We only release your personal information as specifically provided herein or in accordance with our Privacy Policy or otherwise in compliance with New Zealand law. We take all practicable steps to ensure that any personal information we collect is securely protected.
You consent to receiving emails and other communications from us in relation to your booking and the third-party suppliers as well as any other deals that we consider relevant for you.
14. General
These terms shall be governed in accordance with the law of New Zealand and you submit to the exclusive jurisdiction of the New Zealand courts.
These terms shall be binding on the legal representatives, permitted assignees, and successors of the parties.
If any provision of these Terms shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.
No failure or delay on the part of either party in exercising any power or right under these Terms will operate as a waiver, nor will any single or partial exercise of such right or power preclude any other or future exercise of the same, or any other right or power contained in these terms and conditions.
For the purpose of section 12 of the New Zealand Contract and Commercial Law Act 2017, the undertakings contained in this agreement are intended to create a benefit in favour of, and enforceable by, our directors, agents and employees and third-party suppliers and operators.
All notices sent to you pursuant to these terms will be sent by email to the email address provided by you at the time you make a booking.
15. Revised Terms
We may revise our booking terms from time to time by updating the posting of this document on our website or by giving notice to you by email. We require you to carefully read these terms whenever you make a booking with Coach Journeys New Zealand Limited or you submit any information to us. These booking terms supersede any prior versions.
16. Complaints
During your New Zealand holiday, if a problem arises, please notify us as soon as possible so that you can continue to enjoy your coach journey. You will also need to alert the tour operator/supplier concerned. We will endeavour to do our best to ensure your complaint is handled as soon as possible. Your complaint must be submitted in writing within 30 days of your return to your home country if it cannot be satisfactorily resolved at that time. You must follow the procedures for submitting complaints outlined above in order for us to accept liability.
